Welcome to AI-Image-Agent. By accessing and using our AI-powered image generation service, you acknowledge and agree to comply with these terms and conditions. AI-Image-Agent is an advanced platform that allows users to generate and edit images from text prompts and reference photos using cutting-edge artificial intelligence.
1. Acceptance of Terms
By using AI-Image-Agent, you agree to be bound by these Terms and Conditions, our Privacy Policy, and any additional terms that may apply to specific features or services. If you do not agree to these terms, please do not use our service. These terms become effective immediately upon your first use of the AI-Image-Agent platform.
2. Service Description
AI-Image-Agent provides an AI-powered image generation service that uses advanced deep learning models to generate images from prompts and to edit images supplied by you. Our service includes:
- Text-to-image generation with eight AI models, including Flux, Nano Banana, Seedream and GPT Image
- Image-to-image editing with up to five reference images per request
- Nine aspect ratios, three output formats (JPG, PNG, WebP) and 1K/2K/4K output
- High-resolution output for personal and commercial use (based on plan)
- Credit-based billing across the free allowance, monthly subscriptions and top-up packs
The list of models changes as providers release and retire them. The model selector inside the generator is the authoritative list at any given moment; a model shown on a marketing page may be unavailable temporarily.
We do not sell visual "styles" as a separate product, and we do not guarantee any particular aesthetic result. The output is produced by the model from your prompt and, in image-to-image mode, from your reference images.
Some features mentioned elsewhere on the site are not available yet. Batch generation, for example, is labelled "Coming soon" on the pricing page and is not included in any plan today. Where a marketing page and the pricing page disagree about whether a feature exists, the pricing page label controls.
Service availability and features may vary based on your subscription plan. Generation may also fail for reasons outside our control (model provider outages, content-filter rejections); failed generations are refunded in credits as described in Section 9.3.
3. User-Generated Content and Image Uploads
You are responsible for all images, text prompts, and content you submit to our service. By uploading images or providing prompts, you represent and warrant that:
- You own the rights to the uploaded images or have obtained necessary permissions
- Your content does not infringe on intellectual property rights of others
- Your content does not violate any applicable laws or regulations
- You will not upload images containing illegal, harmful, threatening, or defamatory content
The image-to-image feature accepts up to five reference images per request, each up to 10MB. When a reference image contains a real, identifiable person, you must be that person or hold their explicit permission to use their likeness — this applies to private individuals and to public figures alike. Uploading someone else's image to create intimate, degrading, or misleading depictions of them violates Section 5.1 and may be a criminal offence in your jurisdiction.
You agree not to submit content that:
- Contains explicit sexual content, extreme violence, or hate speech
- Attempts to impersonate real individuals without their consent
- Infringes on privacy rights or personal data of others
- Contains malware, viruses, or malicious code
4. AI-Generated Images and Usage Rights
Images generated through AI-Image-Agent are created using proprietary artificial intelligence technology. Subject to these terms and your subscription plan:
- Free Plan Users: Generated images may be used for personal, non-commercial purposes only and may include watermarks
- Paid Plan Users: Generated images may be used for personal purposes without watermarks
- Commercial License Holders: Full commercial usage rights as specified in your license agreement
You acknowledge that:
- AI-generated images may not be protected by traditional copyright laws in all jurisdictions
- Similar images may be generated for other users with similar prompts or source images
- You should not claim exclusive ownership over AI-generated content
- You are responsible for ensuring your use of generated images complies with applicable laws
- AI-Image-Agent retains the right to use anonymized data about transformations to improve our services
5. Prohibited Uses and Prohibited Content
The rules in this section apply to everything you submit to AI-Image-Agent and everything you produce with it — text prompts, uploaded source images, and generated outputs — across every generation type we offer (text-to-image, image-to-image, and image editing).
5.1 Six prohibited content categories
You may not submit, request, generate, store, publish, or share content that falls into any of the six categories below.
- Child sexual abuse material (CSAM) and any sexualization of minors — zero tolerance. No content that depicts, describes, implies, or sexualizes a person under 18 years of age, whether photorealistic, illustrated, animated, or stylized. Age-ambiguous subjects presented in a sexual context are treated as prohibited, and so are "aged-up" or "young-looking" versions of a minor. We do not issue warnings for this category: a violation results in immediate permanent account termination, deletion of all associated content, forfeiture of unused credits, and a report to the relevant authorities (including NCMEC and/or local law enforcement).
- Sexually explicit content and non-consensual intimate imagery. Pornography, nudity, sexual acts, fetish content, "undress" or "nudify" workflows, and any intimate or revealing image of a real person created, altered, or shared without that person's consent.
- Violence, gore, and incitement to harm. Graphic violence, torture, mutilation, cruelty to animals, and content that glorifies, instructs on, or encourages terrorism, the construction of weapons, self-harm, or suicide.
- Hate speech, harassment, and discrimination. Content that attacks, dehumanizes, or incites hostility against people on the basis of race, ethnicity, nationality, religion, disability, gender, gender identity, sexual orientation, or age; threats, bullying, stalking, and doxxing.
- Deepfakes, impersonation, and deceptive use of a real person's likeness. Depicting an identifiable real person — public figure or private individual — in a false, defamatory, or misleading context without consent; fake identification documents, fake evidence, fake news imagery, or fabricated endorsements.
- Copyright and trademark infringement. Reproducing protected characters, logos, brands, artwork, or licensed imagery without holding the rights, and presenting generated output as official, licensed, or endorsed merchandise.
5.2 Prohibited conduct
- Generating content for illegal activities, fraud, or deception
- Attempting to reverse engineer, decompile, or copy our AI technology or algorithms
- Using automated systems, bots, or scripts to generate excessive requests or abuse our service
- Reselling or redistributing our service without authorization
- Deliberately circumventing content filters, usage limits, watermarks, or security measures
- Using the service, or its output, to build or train a competing model
5.3 Consequences of a violation
Depending on severity, a violation may result in one or more of the following: removal of the offending content; forfeiture of the credits consumed, without refund; a warning; temporary suspension; permanent termination of your account; refusal of further service; and — where the law requires it, or where the content suggests a risk of serious harm — referral to law enforcement. We may also report the account to our payment provider. Section 6 explains how we detect violations and how you can report them.
6. Content Moderation, Reporting, and Enforcement
6.1 How we moderate
Every request is screened by the safety filters of the underlying model providers (for example Google, Black Forest Labs, ByteDance and OpenAI models served through Replicate) before and after the model runs. A request that trips a filter is rejected and the credits spent on it are returned automatically. We do not currently run a separate in-house prompt filter of our own: our own review of content is report-driven, as described in 6.3.
Automated filters are not perfect. Content that gets past them is still a violation of Section 5, and we act on it as soon as we learn about it — including deleting the image, closing the account, and, where required, reporting it.
6.2 How to report content or a user
Email [email protected] with the subject line "Content report", or use the contact form on our About page. Anyone can report — you do not need an account.
To make a report actionable, please include:
- The URL of the generated image, or the account and prompt involved
- A short description of which category in Section 5.1 the content falls into
- When and where you saw it
- Whether a minor may be at risk (this moves the report to the front of the queue)
6.3 What happens after a report
- We acknowledge reports within 2 business days. Reports involving CSAM or an imminent risk to a person are handled as urgent, within 24 hours.
- A human reviewer examines the content, the prompt, and the account history, and may freeze the account while the review is running.
- If the report is upheld, we remove the content, apply the measures in Section 5.3, and reply to the reporter with the outcome in general terms (without disclosing another user's personal data).
- If the report is not upheld, we tell the reporter why.
- CSAM cases are preserved for evidentiary purposes and reported to the authorities as described in Section 5.1.
6.4 Appeals
If your account or content was actioned and you believe it was a mistake, reply in the same email thread within 30 days. A reviewer who was not involved in the original decision re-examines it and replies within 5 business days. Appeals do not apply to confirmed CSAM cases.
6.5 Records and cooperation
We keep a record of reports, decisions, and enforcement actions for at least 12 months — and longer for CSAM cases — so that we can detect repeat offenders, answer regulators, and cooperate with law enforcement requests that are valid under applicable law.
7. Service Availability and Limitations
AI-Image-Agent is provided "as is" and "as available" without any warranties. We strive to provide reliable service but do not guarantee:
- Continuous, uninterrupted, or error-free service operation
- Specific quality, accuracy, or artistic results in generated images
- Permanent storage or preservation of your generated images beyond specified retention periods
- Compatibility with all devices, browsers, or operating systems
- That the service will meet your specific requirements or expectations
We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice. We may impose usage limits or restrictions based on your subscription plan or to prevent abuse.
8. Subscription Plans and Payments
AI-Image-Agent offers various subscription plans with different features and usage limits. By subscribing to a paid plan:
- You agree to pay all fees associated with your chosen plan
- Subscriptions automatically renew unless canceled before the renewal date
- Refunds are subject to our refund policy (Section 9)
- We may change pricing with 30 days notice to existing subscribers
- Failure to pay may result in service suspension or termination
9. Billing, Cancellation, and Refunds
This section is our full refund policy. It explains how payments are processed, how to cancel, when we refund, when we do not, and how long a refund takes.
9.1 How payments are processed
Payments are handled by our payment providers — Creem or Waffo (Pancake), depending on the option you choose at checkout. Both act as the merchant of record. We never see or store your full card number. Your receipt and invoice come from the provider you paid with and contain the transaction ID you will need for any refund request.
9.2 Auto-renewal and cancellation
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from Account → Subscription, or by emailing [email protected]. Cancellation takes effect at the end of the period you have already paid for: you keep access until then, and you are not charged again. Cancelling stops future charges; on its own it does not refund the period already paid — see 9.4 for that.
9.3 Credits
Credits are the unit consumed by each generation. A failed generation is refunded automatically, usually within minutes. If a generation fails and the credits are not returned within 24 hours, email us with the time of the request and we will return them manually. Credits are personal, non-transferable, have no cash value, and any expiry is stated on the plan you bought.
9.4 When we refund
- Charged in error — duplicate charge, wrong amount, or a charge you did not authorise: full refund of the affected amount, at any time.
- First subscription purchase — request within 14 days of the charge, provided you have consumed less than 20% of the credits included in that period: full refund, and the subscription is closed.
- Service failure — the service was materially unusable for you (for example, no generation succeeded at all) and we could not fix it: full or partial refund of the affected period.
- Unused credit packs — request within 14 days of purchase, provided none of the credits in that pack have been used.
- Where the law requires it — nothing in this policy limits mandatory consumer rights available to you in your jurisdiction.
9.5 When we do not refund
- Renewal charges after the first billing period (cancel before the renewal date to avoid them)
- Credits already consumed by successful generations
- Requests made more than 14 days after the charge, other than where a statutory right applies
- Accounts terminated for violating Section 5
- Dissatisfaction with the artistic quality of an image that was generated as requested — the free trial and the per-model credit pricing exist so you can judge that before paying
9.6 How to request a refund
The same policy, with a summary table, is also published as a standalone page at /refund.
Email [email protected] with the subject line "Refund request" and include: the account email, the charge date and amount, the transaction or invoice ID from your receipt, and a one-line reason. We reply within 2 business days. Approved refunds are returned to the original payment method within 5–10 business days; the exact timing depends on your bank or card issuer.
9.7 Chargebacks
Please contact us before opening a chargeback with your bank — nearly every case can be resolved faster by email. Accounts with an open chargeback may be suspended until it is resolved.
9.8 Price changes
We may change subscription prices. Existing subscribers are notified by email at least 30 days before a change takes effect, and the change applies from your next renewal. Cancelling before that renewal avoids the new price.
10. Privacy and Data
We may collect and process your uploaded images, prompts, and generated images to provide and improve our service. By using AI-Image-Agent, you consent to such processing as described in our Privacy Policy. Please review our Privacy Policy for detailed information about how we handle your data, including:

Your continued use of AI-Image-Agent after changes constitutes acceptance of the modified terms. If you do not agree with the changes, you must stop using the service.
15. Termination
We may terminate or suspend your access to AI-Image-Agent immediately, without prior notice or liability, for any reason, including but not limited to:
- Violation of these terms or our policies
- Conduct that is harmful to other users or our service
- Fraudulent or illegal activities
- Non-payment of fees
Upon termination, your right to use the service will immediately cease. You may terminate your account at any time by contacting us or through your account settings.
16. Governing Law and Dispute Resolution
These terms are governed by and construed in accordance with applicable international laws. Any disputes arising from these terms or your use of AI-Image-Agent shall be resolved through:
- Good faith negotiation between parties
- Mediation if negotiation fails
- Binding arbitration or appropriate legal jurisdiction as applicable
17. General Provisions
These terms constitute the entire agreement between you and AI-Image-Agent. If any provision is found unenforceable, the remaining provisions will continue in full effect. Our failure to enforce any right or provision does not constitute a waiver. You may not assign your rights under these terms without our consent.
18. Contact Information
AI-Image-Agent is operated by an independent developer (a sole operator), not by a company or an agency. It is a small, independently run product built on third-party model providers, and it does not have a support organisation behind it. If you have a question about these terms, a payment, or a takedown request, use the address below — it reaches the person who runs the service.
